Who gets to Print the Presidential Ballot Papers? - The Court of Appeal Decision


20/07/17 - Well Al Ghurair's printers can now be switched on to Presidential Ballot Paper printing mode (if they weren't already printing). The CoA has pronounced itself and as is consistent in a society that values the rule of law, it must be respected ... or appealed. But no not an appeal again NASA ..... Let the elections proceed! 
For a fact, it throws the Article 10 principle on public participation into a spin. Yes political expediency Court of Appeal ... but my lords, what does public participation mean to you!? At least give us some direction... 
Well the cases might have been filed to address interests of candidates but the issues raises certainly raise matters of public interest, we are all stakeholders in Kenya's electoral processes. 
I have come to appreciate public interest litigation to mean litigation where there is no winner looser distinction. At the end of exercise, persons have been given an opportunity to ventilate, matters which would have been deemed peripheral have been brought to the fore, it has sparked debate at different levels of society ... this too is an effect, an outcome of litigating in the public interest. 
Kenyans now know about tendering, how independent IEBC must not only be but be seen/perceived to be etc. 
My take home; whatever the political divide, IEBC MUST serve all Kenyans, IEBC must exhibit and inspire confidence in the electoral process, and most important, Kenyans MUST BE VIGILANT AT EVERY STAGE OF THE ELECTORAL PROCESS!

LATEST COURT OF APPEAL APPOINTMENTS - Kudos JSC!!

Once again the JSC is 'on-point' in its latest appointment of 7 new judges of the Court of Appeal. The ration of appointments is clearly in favour of the women i.e. 5 out of the 7 are women. This follows the earlier appointment of 28 new judges of the High Court 13 of whom were women. Indeed, the Court of Appeal has been largely identified with a perpetual delay in the administration with many calling upon it to work at changing its public image. Indeed, the Justice William Ouko led Task force report not only only found that there were vacancies at the court of appeal (11 instead of the then 14 allowed) but even out of the 11 judges, there was no woman judge at the Court of Appeal. The Constitution of Kenya, as a result of a reflection on some of these grave inequities and disparities is very clear on the issue of gender representation at all levels of and in all arms of government. Integrity and Moral Probity…..hmmmmh?!?!?

As vetting approaches and the potentially high number of judicial officers likely to face the ‘phase 2’ purge… lawyers are falling over each other trying to polish their résumés in the hope of filling up the already empty slots as well as the soon to be vacancies. Hence begs the questions, are these legal practitioners (even with their impressive résumés) going to qualify for these positions? Are they really going to prove that they are persons of integrity? Are we likely to get a fresh deluge of ‘wikileakes’ discrediting their claims as persons of integrity?
